1. ACCOMODATION RULES

Dear guests,

We want you to have a fantastic experience both in the Danube Delta and in our holiday home and that is why we have established a series of principles and rules that we respectfully ask you to take into account both during and after your stay has ended. The regulation applies to all guests, who accept it by the very fact of their accommodation in the holiday home and must comply with it without limits or reservations.

Reservation  

The reservation is made by direct contact of the property, by email at office@gorgovadeltavillage.ro or by phone/WhatsApp 0723417734 / 0747127824, or via specialized booking websites. The reservation is guaranteed by a deposit equivalent to one night's accommodation and can be cancelled free of charge at least 7 days before the start of your stay. Cancellation after this deadline entails the loss of the deposit paid. A shortening of the stay, announced less than 7 days before the beginning of the stay, implies the payment of all the nights of accommodation from the initial reservation.

Arrival and departure  

The reception of the room (check-in) can be made starting with 14:00, presenting the identity document for registration.

Check-out shall be done before 11:00.

If on the first day of stay you want to check-in before 14:00, the request will be honored within the limit of availability and an early check-in fee of 20 euros will be applied, VAT included (for the interval 09:00-14:00).

If on the last day of stay you want to check-out after 11:00, the request will be honored within the limit of availability and a late check-out fee of 20 euros will be applied, VAT included (for the period 11:00-16:00).

It is not possible to leave your luggage in the accommodation unit (indoor or outdoor) after the check-out time.

Accommodation  

Guests are aware of the following rules and undertake to comply with them:

– not to damage the arrangement or objects of the unit, otherwise they owe the unit the amount equal to the value of the purchase / arrangement of the damaged object and the related workmanship;

– not to take over goods from the accommodation on departure;

– maintain a decent level of noise so as not to disturb the neighbours;

– not to use towels or linen or decorative bedding for: wiping dyed hair, for cleansing, cleaning shoes, suitcases, floors, outdoor use, etc. Towels will be used for body use only. If towels or linen damaged by the improper use of the tourist are identified, they will be charged as damage and will be paid by the responsible tourist. Otherwise, the accommodation unit reserves the right to cancel the reservation of the tourist's room and to make his evacuation without refunding the value of the services paid.

– not to enter the premises intended only for the staff of the unit;

– to notify the persons coming to visit not being accommodated in the unit;

– not to leave children unattended in any of the accommodation's premises; any accident caused as a result of the non-supervision of children on the premises of the accommodation is not our responsibility but that of the persons accompanying the children and are in charge of their supervision; this is also true on the pontoon of the pension, located on the bank of the Sulina branch;

– to notify as soon as possible any malfunction of the appliances, installations or other technical non-conformities/furniture in the accommodation unit's equipment;

– any accident caused as a result of the improper use of the objects in the endowment or of the use of the pension's facilities without observing the security rules corresponding to them is not the responsibility of the accommodation unit.

– after use and before leaving the room, remove the chargers of the electrical / electronic devices (laptop, mobile phone, photon camera, etc.) from the electrical supply sockets.

– do not clean fish at the fountain in the yard, but on the dedicated table in the yard, using the water from the garden hose;

- children aged 0-6 years will be accommodated free of charge if they share the same bed with their parents; children aged 7-12 years are accommodated with a supplement of 50 lei/night accommodation; children and persons over 13 years are accommodated with a supplement of 100 lei/night of accommodation. Additional fees apply only to persons in addition to the accommodation capacity of 4 places in single beds and double. 

– for children under 2 years old there is the possibility to offer, free of charge, a crib. Please let us know when you make your booking if you need a baby crib;

– there is no possibility to install additional beds;

– at least one of the tourists accommodated must be at least 20 years old;

– the accommodated tourists are solely responsible for fulfilling the access requirements to the Danube Delta Biosphere Reserve and for observing the rules imposed by law, for visiting and fishing.

Environmental protection policy  

Environmental protection is a permanent concern for us, which is why we promote a responsible attitude in this regard.

– do not throw objects in the toilet that could lead to damage to the waste collection station;

– garbage and household waste will be stored in household garbage bins, and recyclable waste will be stored in containers / bins dedicated to recycling;

– cooking oil or fat is stored in the containers made available under the sink and not thrown into the sink;

Smoking  

Traditional smoking and electronic cigarettes are not allowed inside the pension, according to the applicable legislation in force (Law 349/2002 amended and supplemented by Law 15/2016). The pension has arranged spaces for outdoor smokers. We inform you that in each room there are sensors that detect cigarette smoke and trigger the fire alarm.

If the provisions of this Regulation are not complied with, a fee of 150 euros / night will be applied (the value in lei will be calculated at the NBR exchange rate on the day of payment), representing the cleaning services of the room.

Pets  

The general rule does not allow the accommodation of people accompanied by animals.

Parking space and cars  

Parking is possible on the space in front of the property (outside the roadway space). Although the property benefits from external video surveillance (and only external!), we do not take responsibility for theft or damage on the surface of our property. To avoid these inconveniences, do not leave valuables inside the cars.

Disputes and complaints  

The pension undertakes to solve any complaint received from the guests in connection with the services provided at the location of the accommodation structure in efficient time from the moment of its formulation. Any controversy, dispute or complaint that may arise from the application of these terms and conditions, we will try to resolve it amicably. If this is not possible, it will fall under the jurisdiction of the courts in Bucharest.

Selection of guests  

The customer must comply with hotel usages. It will have to respect both the peace and public order, as well as the norms of social and moral cohabitation.

Also, the guest of the pension must take care of the property of the pension left in his use during the accommodation. Any violation of hotel usages or moral norms and social cohabitation entitles the accommodation unit to immediately interrupt the contract / accommodation, without any notice.

We reserve the right to refuse accommodation to intoxicated, rude or turbulent guests, who by their attitude harm the image of the guesthouse or disturb other guests. The value of any destruction or degradation of the material assets belonging to the pension will be borne by those guilty of producing them.

We reserve the right to evacuate guests with inappropriate attitude from the accommodation unit.

Considering the above mentioned, we reserve the right to select our guests.

We do not agree to: uncivilized or aggressive behavior, obscene physical or verbal manifestations, inappropriate tone, insults, physical, sexual harassment or any physical or mental abuse of a person, guests or any person in the accommodation complex.

The unit's management may stop providing services to those guests who do not comply with the Accommodation Rules.

Fire protection  

The rooms are equipped with smoke detectors, which, if triggered, will emit acoustic and light signals. When triggering a smoke alarm, guests must evacuate the building immediately, without returning after their personal belongings.

The house is also equipped with foam fire extinguishers, their label shows the instructions for use.

Do not resort to improvisations of the electrical installation for supplying electrical receptors. If you notice any deficiencies in this regard, you immediately notify the staff. Do not use unapproved personal electrical appliances. Do not try to fix the faults or errors of the appliances in the unit yourself.

Do not introduce flammable, explosive or toxic substances into the building of the guesthouse.

Do not smoke in the room.

Do not use the open fire in the courtyard. The barbecue should only be used under supervision and at a distance from the house. Don't bring the barbecue near the house! Sparks can ignite the reed roof.

In case of a fire, the emergency services are notified at the unique emergency number 112.

2. INFORMATION NOTE ON THE PROCESSING OF PERSONAL DATA

Gorgova Delta Village, located in Gorgova, Str. Dunării nr. 50, jud. Tulcea, web: www.gorgovadeltavillage.ro, e-mail: office@gorgovadeltavillage.ro is managed by SMART LOCKER ROMANIA S.R.L. located in Bucharest sector 5, str. Cap. Ivan Anghelache nr. 2, Bl. M28, Ap. 50, registered with the Trade Register under no. J40/6382/2019, with VAT number RO41113511, hereinafter referred to as Society.

For the Company, it is very important to protect the personal data made available to us by direct communication or electronically by any person interested in benefiting from the company's services (client / potential client, visitor or subscriber of the services offered by the company) or by our collaborators (travel agents). In carrying out the company's object of activity, only the authorized personnel and only for the necessary actions have access to the personal data of the data subjects.

We base our relationship with the beneficiaries of our services on respect for customers, privacy, confidentiality of information, dignity and respect for their rights as data subjects, in accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of the European Union on the protection of individuals with regard to the processing of personal data and on the free movement of such data.

The company processes the personal data provided by you, by automated and manual means, for the purpose of processing the registration of customers, their requests and the fulfillment of the following services and activities, as appropriate:

– execution of reservation requests, through the online or offline reservation systems used by the Company (phone, email, website, Booking.com etc.);

– offering and providing accommodation and leisure hotel services;

– processing orders and contracts, informing about the status of orders and services offered;

– accommodation and completion of payment formalities;

– invoicing of accommodation and other related services, preparation of accounting statements and tax returns;

– settlement by contracting units of holiday vouchers;

– making information, management reports for internal processing for the purpose of managing the company's activity, for the purpose of tracking and monitoring accommodations / sales;

– carrying out mandatory reports/analyses required by I.N.S. and A.R.B.D.D. (making statistical records on the number of tourists, accommodation capacity and other indicators specific to accommodation services);

– ensuring the security and integrity of the goods and values of tourists and the operator;

– solving requests, questions, customer complaints;

– other related activities, according to the object of activity.

The normative acts regulating the activities and obligations that we are required to comply with as a provider of accommodation services are the following:

  • H.G. no. ANRE President's Order no. 237/2001 for the approval of the rules on access, record keeping and protection of tourists in touristic reception structures, republished;
  • O.G. nr. 58/1998 on the organization and conduct of tourism activity in Romania;
  • Law nr. 227/2015 on the Fiscal Code;
  • Order of the M.F.P. no. 2634/2015 on financial accounting documents;
  • Law nr. 333/2003 on the security of objectives, goods, values and protection of persons, with subsequent amendments and completions;
  • Methodological norms for the application of Law nr. 333/2003, approved by HG nr. 301/2012, with subsequent amendments;
  • Decision No. ANRE President's Order no. 52/2012 on the processing of personal data through the use of video surveillance means, issued by the president of the National Supervisory Authority for Personal Data Processing (ANSPDCP);
  • O.U.G. nr. 97/2005 regarding the evidence, domicile, residence and identity documents of Romanian citizens, approved by Law no. 290/2005, republished, with subsequent amendments;
  • H.G. no. 1.375/2006 for the approval of the Methodological Norms for the uniform application of the legal provisions regarding the records, domicile, residence and identity documents of Romanian citizens;
  • H.G. no. 839/2006, regarding the form and content of identity documents, of the sticker on the establishment of residence and of the real estate card;
  • any other normative acts in force with incidence in the field of activity of the company.

The processing of personal data is carried out by the company and its proxies pursuant to Art. 6 para. 1 points (b), (c) and (f) of Regulation (EU) 2016/679 of the European Parliament and of the Council of the European Union on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, namely: for pre-contractual arrangements or the performance of a contract (provision of accommodation, leisure services, communication with customers in relation to any request or relevant aspect related to the commercial relationship, etc.), in order to fulfill the legal obligations of the operator (our obligations as a travel service provider, drawing up and registering the arrival and departure notification sheet, registration in the hotel management program, issuing accommodation invoices and other related services, accounting registration, financial management, archiving, ensuring the security and integrity of tourists' goods and values and the operator's patrimony, etc.), as well as for the fulfillment of the legitimate interest pursued by the operator (legitimate interest in providing services in the company's field of activity, management of the relationship with the public / customers).

You are obliged to provide the personal data requested at the time of booking / staying in the pension, registering / subscribing to the company's services, requesting the reservation of an event or invoicing the services within the company, the data being necessary to fulfill one or more of the purposes mentioned above. The refusal to communicate the data determines for you the impossibility of booking the accommodation / of carrying out the accommodation formalities and of the payment of the touristic services, the impossibility to benefit from the company's services.

The collection of personal data by using the video surveillance means installed in the company's premises is done with your consent (understanding and accepting the meaning of the indicator "Video surveillance area"). The video surveillance system is used to ensure the safety and security of the locations. Since the processing of personal data (image) through the means of video surveillance is mandatory, the refusal of the person to provide the respective data determines the cancellation of his access to the company's premises.

We inform you that, in order to fulfill the aforementioned purposes, we process the following types of personal data: name and surname, personal identification number (for billing purposes), domicile, serial number and ID number / passport, citizenship, date of birth, place of birth, gender, data about family members – age (in the case of minors for setting the accommodation fee), telephone number, email address, bank details (in the case of payment by bank card, in the case of using the online booking platforms of the operators such as Booking.com, other travel agencies with which contracts are concluded, or other third parties), the place of work (in the case of payment with holiday vouchers or meal vouchers), the image (in the spaces where video surveillance cameras are located, indicated by visible signs), the registration number of the car (to ensure parking), preferences/habits (e.g. room type, preferences for booking accommodation/dining), purpose of the trip, date of arrival/departure date, signature.

The data collected are intended for processing by the data controller and its proxies (accounting/ billing program provider, IT maintenance, website hosting, etc.), being transmitted only for the purpose of executing their legal obligations to the state authorities entitled by law, respectively A.N.A.F., M.A.I., The Ministry of Tourism, I.N.S. or other competent control authorities, if applicable.

Personal data are processed throughout the contractual relationship for the provision of accommodation and leisure hotel services, as well as after its completion, until the expiry of the legal archiving terms, respectively only for the duration necessary to comply with the legal obligations of the company or its proxies. The personal data processed by video means (image) are deleted or destroyed after a maximum period of 30 days, unless, a legal provision, the request of a competent state authority or the conduct of a dispute, etc., requires the retention of this data for a longer period of time.

According to Regulation (EU) 2016/679 of the European Parliament and of the Council of the European Union on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and on the provisions of national legislation on the protection of individuals with regard to the processing of personal data and on the free movement of such data, you benefit from the right of access, the right to rectification, the right to object, the right not to be subject to an individual decision, the right to delete the data, the right to restrict the processing, the right to data portability, under the conditions provided by the Regulation.

We undertake to apply all appropriate technical and organizational measures to ensure the security of your personal data, to protect them against destruction, modification, disclosure or unauthorized access to them.
